2. Where the Member of the Court who decides to resign is the President, he/she shall announce his/her decision to the Vice President who shall notify the Chairperson of the African Union Commission and the resignation shall take effect in accordance with the terms of sub-rule 1 of the present Rule. Rule 7 Suspension or Removal 1. Where the application of article 19(1) of the Protocol is under consideration, the President or, if the circumstances so require, the Vice-President, shall inform the Member of the Court concerned accordingly, in a written statement which shall include the grounds thereof and any relevant evidence. He/she shall, subsequently, at a private session of the Court specially convened for the purpose, be afforded an opportunity of making a statement, of furnishing any information or explanations he/she wishes to give, and of supplying answers, orally or in writing, to any questions put to him/her. At a further private session, at which the Member of the Court concerned shall not be present, the matter shall be considered; each Member of the Court shall state his/her opinion and, if requested, a vote shall be taken. 2. Any decision to suspend or remove a Member of the Court shall be communicated to the Chairperson of the African Union Commission. Rule 8 Inability to Sit, Exemption and Withdrawal 1. Any Member of the Court who is unable to attend a sitting of the Court shall notify the President as early as possible. 2. In accordance with article 22 of the Protocol, any Member of the Court who is a national of a State that is party to a case shall abstain from hearing that case. 6
