Rule 44
Conduct of Hearings
The Presiding Judge shall conduct the hearing. He/she shall
prescribe the order in which the representatives of the parties and
where applicable, the representatives of the Commission, are to be
heard.
Rule 45
Measures for Taking Evidence
1. The Court may, of its own accord, or at the request of a party, or
the representatives of the Commission, where applicable, obtain
any evidence which in its opinion may provide clarification of the
facts of a case. The Court may, inter alia , decide to hear as a
witness or expert or in any other capacity any person whose
evidence, assertions or statements it deems likely to assist it in
carrying out its task.
2. The Court may ask any person or institution of its choice to
obtain information, express an opinion or submit a report to it on
any specific point.
3. The Court may, at any time during the proceedings, assign one
or more of its Members to conduct an enquiry, carry out a visit to
the scene or take evidence in any other manner.
