7. not raise any mater or issues previously settled by the parties in
accordance with the principles of the Charter of the United Nations,
the Constitutive Act of the African Union, the provisions of the
Charter or of any legal instrument of the African Union.
Rule 41
Filing of Documents
The Court may, before the commencement of or during the course
of the proceedings, call upon the parties to file any pertinent
document or to provide any relevant explanation. The Court shall
formally note any refusal to comply.
CHAPTER III: ORAL PROCEEDINGS
Rule 42
Fixing of the Date of Hearing
When the case is ready for hearing, the President shall, after
consulting the parties or the representatives of the Commission, if
applicable, fix the date of the hearing. The Registrar shall notify
them accordingly.
Rule 43
Public Hearings
1. Cases shall be heard in open court.
2. However, the Court may, of its own accord or at the request of a
party, hold its hearings in camera if, in its opinion, it is in the
interest of public morality, safety or public order to do so.
3. Whenever the Court orders that any proceedings shall not be
conducted in public, the Court shall give one or more of the reasons
specified in sub-rule 2 of this Rule as the basis of its decision. The
