1. CIRCUMSTANCES OUT OF WHICH THE ACTION AROSE
This action is for a claim for reparation and payment of compensation to the victims
of the 20th September, 2013 raid of an uncompleted building situated at Aderemi
Adesoji Crescent Apo Zone E in the Federal Capital Territory of the Federal
Republic of Nigeria by the officers and men of the 2 nd and 3rd Defendants in the
course of the raid of the premises in search of weapons allegedly buried by suspected
members of the dreaded Boko Haram Terrorist Group.
2. THE PLAINTIFFS’ CASE
On Friday, the 20th September, 2013 about 12.00 am, some armed men comprising
officers and men of the 2nd and 3rd Defendants raided an uncompleted building at
Aderemi Adesoji Crescent Apo Zone E on the alleged suspicion that there are
likely weapons buried in the vicinity by members of the dreaded Boko Haram
Terrorist Group and that some of the Terrorist are occupying the building.
Owing to the alleged suspicion, the members of the 2nd and 3rd Defendants went to
the building heavily armed and fired several gun shots into the building without
any warning or regard to any of the standard rules of engagement. The
uncompleted building had been used by the Applicants and other menial job
workers as their makeshift residence upon payment of a weekly rent of N200 to
the Security guard at the premises.
The victims who were residents in the uncompleted building alongside over one
hundred persons, who lived as tenants in the uncompleted building, were deep
asleep and were awaken by the gunshots from the men of the 2nd and 3rd Defendants
and they started running for their dear lives upon hearing of the gunshots.
