60 GUZZARDI v. ITALY JUDGMENT PARTLY DISSENTING OPINION OF JUDGE MATSCHER Asinara on 8 February 1975 being in substance but a prolongation of the applicant’s detention on remand. I conclude from the above that Mr. Guzzardi’s compulsory residence on Asinara from 8 February 1975 to 22 July 1976, even if one considered that it should be classified as a deprivation of liberty within the meaning of Article 5 § 1 (art. 5-1) of the Convention, was covered by sub-paragraph (c) of that Article (art. 5-1-c).
