25. The protesters tried to run away but they were chased and
fired upon by the security agents, who fanned out through
the community. Apart from those who were shot in their
homes, most people were shot from behind, as they ran.
26. As people ran away, members of the security forces
followed them into the waterfront, shooting as they went.
According to witnesses, security forces continued
right
through the waterfront up to the waters' edge. There were
bullet holes in buildings and structures along the route that
the security forces used.
27. After the
shooting,
members
of the security
forces
accompanied enumerators into the waterfront to continue
with their work.
28. The plaintiffs contend that the above highlighted unan
rights, economic, social and cultural rights as well as civil
and political rights, are recognized and guaranteed by the
African Charter on Human and Peoples' Rights, the
International Covenant on Economic, Social and Cultural
Rights and the International Covenant on Civil and Political
