degrading punishment and treatment guaranteed under Article 5 of the Charter regarding the imposition of the death sentence by hanging. VIII. REPARATIONS 124. The Applicant prays the Court to grant him and members of his family reparations in line with Article 27 of the Protocol and Rule 34(5) of the Rules to remedy violations of their fundamental rights. In particular the Applicant prays the Court for: i. An amount of TSH 30,000,000 (Thirty Million Tanzanian Shillings) to the Applicant for moral prejudice; ii. An amount of TSH 20,000,000 (Twenty Million Tanzanian Shillings) payable to his mother Zipporah Michael; iii. An amount of TSH 10,000,000 (Ten Million Tanzanian Shillings) payable to his brother Vumilia Yusuph; iv. An Amount of TSH 10,000,000 (Ten Million Tanzanian Shillings) payable to his brother Edibili Yusuph; v. An order of setting aside the death sentence imposed to the Applicant and his removal from the death sentence; vi. Immediate restoration of the Applicant’s Liberty by release from prison; vii. An amount to be determined by the Court which it considers just to the Applicant for material prejudice suffered; viii. An Order that the above-mentioned amounts are paid tax free within three months of notification of judgment on reparations; ix. An amount to be determined by this honourable court which it considers just to Emmanuel Yusuf Noriega for material prejudice suffered; x. An order that the Respondent reports to the Court within six months of date of notification of the Judgment on merits and reparations and every six months thereafter, until such a time all orders have been complied with; xi. An order that the Respondent publishes the Judgment on merits and reparations within three months of notification in both English and Kiswahili for a period of not less than one year, on official website of the judiciary and ministry of constitutional affairs; 34
