In light of the foregoing, the Claimants prayed for the following: “
A.
A declaration that the tenure of appointment given
to her initially for a period of twenty (20) months
and
subsequent
periodical
extensions
of
the
appointment up to 30th April, 2012, were ultra
vires the powers of the Secretary General and his
deputies and inconsistent with the EAC Staff
Rules and Regulations (2006);
B.
A declaration that she was entitled to a contract
of employment for a period of five (5) years from
the date of assumption of duty renewable once for
another five (5) years;
C.
Special damages for loss of earnings for the
remaining period of seventy eight months (78),
totaling to USD 477,984;
D.
General damages for pain and suffering and
mental anguish as a result of the conduct of the
Respondent;
E.
Aggravated
and/or
punitive
damages
for
the
wanton conduct of the Respondent’s executive
officers; and
F.
Costs of the Claim on a full indemnity basis with
interest thereon.”
The Claimant’s claim was supported by her Statement on Oath
filed on 11th March 2013 and oral and written submissions.
