of the UDHR is in pari materia with the aforementioned provision of the African Charter. 11. The Applicant also alleges that the Respondent violated his right to a fair hearing under Articles 7 and 10 of the African Charter and the UDHR respectively, by failing to notify him of the auction proceedings prior to the sale of his property. Article 7 of the African Charter provides as follows: “Every individual shall have the right to have his cause heard. This comprises: a) The right to an appeal to competent national organs against acts of violating his fundamental rights as recognized and guaranteed by conventions, laws, regulations and customs in force; b) The right to be presumed innocent until proved guilty by a competent court or tribunal; c) The right to defence, including the right to be defended by counsel of his choice; d) The right to be tried within a reasonable time by an impartial court or tribunal” c) Reliefs Sought 12. Based on the facts mentioned above, the Applicant seeks the following reliefs from the Court; a) To adjudge and declare that Senegal has violated Articles 9, 15 and 91 of its Constitution; 6
