and cultural conditions which arc likely to have a negative impact on human life do not change or are at least improved. 207. The importance of the right to a satisfactory and comprehensive environment for development is recognised in many international instruments. For example, according to Rebecca GRYNSPAN, then Associate Administrator of the UNDP (at the Development with Culture and Identity Forum): "States must recognise cultural divrfrnces in their laws mid institutions and in the crenfion of policies to ensure that the interests of certain groups are llof ignored or supplanted. And the/ must lo so in ways that do not conflict with other liunmn development goals and strategies, such as Immure rights, building 11 conipetenf Sfnfe, and ensuring erpml opportunifiesfor citizens". 208. Furthermore, Article 10 of the United Nations Declaration on the Rights of Indigenous Peoples states: "Indigenous peoples shall not be forcibly removed from their lands or territories. No relocation shall take place ivitfzout the free, prior and informed consent of the indigenous peoples (O7l(l'Vllt'(l and agreement 017 fair and equitable compensation and, where possible, the option of return". The same applies to ILO Convention 169. Its Article 2 (1) (2) (b) states: "l. Governments, wiffi the participation of the peoples concerned, shall develop coordinated and systematic action to protect the rights of these peoples arid to ensure respect for their integrity. "This action shall include measures to (b) promote thejiill realization of the social, economic and cultural rights of these peoples, with due respect for their social and cultural identity, customs and traditions and institutions"89 209. In its Article 7, the same ILO Convention 169 emphasises on this right of peoples to an environment favorable to development in the following terms " 1. The peoples concerned shall have the right to determine their own priorities for the process of development ns it ajkcts their lives, beliefs, institutions arid spiritual well-being and the lands they occupy or othenoise use, and to exercise ns much control ns possible over their own economic, social and cultural development. Furthermore, these peoples shall participate in the formulation, implementation and evaluation of national and regional development plans and program mes that may directly affect them. 2. The improvement of the living arid working conditions of the peoples concerned and of their standard of heulfh and education, with their participation and co~operation, shall be given priority in the overall economic development plans of the regions they 'ai.(,g\ .
