109. In the instant case, the Court decides that the Applicant shall bear his costs. XI. OPERATIVE PART 110. For these reasons: THE COURT, Unanimously By default, in relation to the Respondent State Jurisdiction i. Declares that it has jurisdiction. Admissibility ii. Declares the Application admissible. Merits iii. Holds that the Respondent State did not violate the Applicant’s right to equality before the law and equal protection of the law, as protected by Article 3 of the Charter, read in conjunction with Article 26 of the ICCPR; iv. Holds that the Respondent State did not violate the Applicant’s right to the presumption of innocence, guaranteed by Article 7(1)(b) of the Charter. v. Holds that the Respondent State did not violate the Applicant’s right to participate in the government of his country, protected by Article 13(1) of the Charter. 23
