taking any measure likely to jeopardise the sustenance of its principles, the achievement of its objectives
and the implementation of the provisions of the Treaty". Consequently, Member States of SADC, including
the Respondent, are under a legal obligation to respect, protect and promote human rights, democracy and
the rule of law.
It is settled law that the concept of the rule of law embraces at least four fundamental rights, namely, the
right to have an effective remedy, the right to have access to an independent and impartial Court or
tribunal, the right to a fair hearing before an individual is deprived of a right, interest or legitimate
expectation, the right to equality before the law and the right to equal protection of the law.
Article 2 (3)
× Each State Party to the present Covenant undertakes: (a) To ensure that any person whose rights or
freedoms as herein recognized are violated shall have an effective remedy, notwithstanding that the
violation has been committed by persons acting in an official capacity; (b) To ensure that any person
claiming such a remedy shall have his right thereto determined by competent judicial, administrative or
legislative authorities, or by any other competent authority provided for by the legal system of the State,
and to develop the possibilities of judicial remedy; (c) To ensure that the competent authorities shall
enforce such remedies when granted.

ratified, states as follows - "Each State Party to the present Covenant undertakes:
