Communication 671/17: Ahmed Abdel Hady EI-Sihaimy & 3 others v. The Arab Republic of Egypt Summary of the Complaint: 1. The Secretariat of the African Commission on Human and Peoples' Rights (the Secretariat) received a Complaint on 23 November 2017 from the European Alliance for Human Rights (AED), the AMAN Organisation, Professor Mostafa Metwaly, Mrs. Noha Alshawadfy Ibrahim Mohammed, Mrs. Heba Aly Ahmed Nada, Mr. Ahmed Abdallah Mohammed Youssef, Mr. Ibrahim Ismail Khalil (the Complainants), on behalf of Ahmed Abdel Hady El-Sihaimy, Ahmed Abdel Moneim Aiy Salama, Sameh Abdallah Mohammed Youssef and Lotfy Ibrahim Ismail Khalil (the Victims). 2. The Complaint was submitted against the Arab Republic of Egypt (Respondent State), which is a State Party to the African Charter on Human and Peoples' Rights (the African Charter). 1 3. The Complainants allege that on 2 March 2016, in a case referred to as No. 22 of 2015 also known as "The Issue of Kafr El-Sheikh Stadium", the Victims were sentenced to death by hanging. They aver that the trial was unfair as it was heard before a military court although the Victims are civilians and that it included torture, fabrication of charges and violations of the right to defence. 4. The Complainants state that the first Victim,. Ahmed Abdel Hady El-Sihaimy, is a married 30-year-old businessman. They allege that he was arrested and forcibly disappeared on 14 April 2015 although the decision of the Public Prosecutor's Office to arrest him states that he was arrested on 30 June 2016, and that during this time, he was tortured and prevented from access to medical care and thereby unable to gain access to a medical report to prove the torture. 5. The Complainants allege that the second Victim, Ahmed Abdel Moneim Salama, a teacher and owner of a publicity and advertising company, was arrested and forcibly disappeared on 20 April 2015 although the decision on the Public Prosecutor's Office to arrest him states that he was arrested on 30 June 2016. They further allege that during this time Mr. Ahmed was tortured and prevented from access to medical care, and as a result unable to gain access to a medical report to prove the torture. 6.
