12. The Complainant contends that 'local judicial remedies are not effectively available to him and to
his clients owing to official mistrust and lack of professional respect existing betuieen the Kenyan
judiciaru and' himself.

13. The Complainant alleges violation of Articles 2, 3, 4, 5, 6, 7,8,9,
18, 19, 20,21,22 and 24 of the African Charter.

Prayers:
14. TIle Complainant requests the Commission to recommend that:
a. Reparations in the amount of 500 Million Kenyan Shillings, as geIl.,~ra.1
damages be
paid to Ms. Ekea for the gross violation of her rights as enshrined under the African
Charter;
b. Reparations in the amount of 3QO Billion Kenyan Shillings, as general damages be
paid to the Complainant for the flagrant violation of his rights under the abovementioned provisions of the AfricanCharter, including deprivation of effective local
remedies; and
c. Interest on [a] and [b] above and costs of the Complaint.
Procedure:

The Secretariat received the Complaint dated 22nd November 2014 and
acknowledged receipt thereof on 17th March 2015. The Commission considered the
Communication at its 18th Extra-Ordinary Session held from 29th July to 7th August 2015
in Nairobi, Kenya, and decided to be Seized of it.
16. On 12th August 2015, the Secretariat informed the parties of the Seizure Decision, by
transmitting it by a letter and Note Verbal, respectively, to both. The letter requested the
Complainant to forward his written submission on Admissibility, within two (2) months, in
accordance with Rule 105 (1) of its Rules of Procedure 2010 (Rules of Procedure 2010). The
Note Verbal informed the Respondent State that the Complainant had been requested to
forward his written submissions on the Admissibility of the matter.
17. At its 57th Ordinary Session held from 4th to 18th November 2015, in Banjul, The Gambia,
the Commission deferred decision on the Communication to a latter Session, pending
receipt of the parties' Submissions on admissibility. The Respondent State and the
Complainant were informed of the Commission's Decision by a Note Verbal, and a letter
dated 25th November 2015, respectively.
