The records of the case show
that the deceased passed on at
the age of
(50) years and was survived by
fifty
a wife
and a four year old child
who is
schooling' There is no record of
any contribution from the State
to the famiry
of the deceased in the organization
of the funeral of the deceased
and no
compensation has been paid to
the family.

In exercise of its discretion in awarding
appropriate compensation, the
court
takes into consideration all the
above mentioned factors, particularly
the
financial obligations towards the
four year child in school, the surviving
spouse and the external family
from which two members gallantly
fought this
matter before this court. The court
orders payment of rump sum
compensation in the sum of Twenty
Milion Naira (N20, 000.000.00) by
the
Respondent for the death of
Mr. Nunugwo in vioration of his
rights as
adjudged.
