The Complainant submits that he is not obliged to exhaust local remedies because, under the domestic laws of the Respondent State, there are no available, effective or sufficient local remedies to redress the violations that are the basis of the Complaint. 15. He also submits that, in the circumstances of the case, this Complaint has been submitted within a reasonable time in accordance with Article 56 (6) of the Charter. Articles alleged to have been violated 16. The Complainant alleges that the Respondent State has violated Articles 1, 5, 6, 7, 9 and 16 of the African Charter on Human and Peoples' Rights (African Charter). Prayers 17. The Complainant prays the African Commission on Human and Peoples' Rights (African Commission) to: a) Find that the alleged violations did indeed take place. b) Make a declaration that the Complainant's arrest, beating, and arbitrary detention in inhumane conditions, constitute multiple violations of his right to be free from torture and cruel, inhuman and degrading treatment, as protected by Article 5 of the African Charter; c) Make a declaration that the Complainant's arrest, beating, and arbitrary detention constitute multiple violations of his right to liberty and security of person, as protected by Article 6 of the African Charter; d) Make a declaration that the Complainant's arrest and arbitrary detention without charges constitute multiple violations of his right to be heard, as protected by Article 7 of the African Charter; e) Make a declaration that the Complainant's arrest and arbitrary detention for reporting on the arrest of Mr. El-Sheikh constitute multiple violations of his right to freedom of expression, as protected by Article 9 of the African Charter; f) Make a declaration that the Complainant's beating and denial of medical attention constitute multiple violations of his right to health, as protected by Article 16 of the African Charter; g) Make a declaration that Sudan's national~~:8:il~ laws, and Sudan's failure to pass 41 Page
