5) Enjoining Messrs. Wakani and Gogoua to ensure that her rights to appeal are
respected, as guaranteed by Article 65 (a) of the Staff Regulations; by recognising her
right to appeal and by presenting a memorandum to the Administration and Finance
Commission;
6) Finally, enjoining the Executive Secretary of ECOWAS to pay to her, salaries and
emoluments attached to her post of Director of Administration, from September 2004
to the date her appeal shall be examined.
6. The Application was served on the Executive Secretary and on Messrs. Wakani
and Gogoua on 21st March 2005.
7. In reply to the action, defendants on 20.04.05, pursuant to Article 35 of the Rules of
the Court filed their process stating their defence.
C. AN INTERIM MEASURE GRANTED BY THE COURT
8. By a
separate application dated 21/03/05,
lodged under
Suit
No.
ECW/CCJ/ APP/01/2005, bearing the same number as the main application; the
Applicant, through her lawyer Wole Adebayo Esq., filed an application on
04/04/05 for expedited procedure, pursuant to Article 59 of the Rules of the
Court, for the purposes of:
1). Abridging the time-limit from one month to 8 days so that the defendants may submit
their defence;
2) Ordering the parties to keep to the status quo ante and thus safeguard the position in
question and restrain the defendants from any recruitment exercise while the case was
being examined on its merits.
9. Under oath, on 13/04/05, Mr. Gogoua, Professional Staff Representative, at the
Executive Secretariat of ECOWAS made depositions that are summarised hereunder:
1) Firstly, that the dismissal of the applicant is consistent ·with the rules and
procedure of the 1999 Staff Rules and the Staff Regulations of the same year;
