141. Article 27(1) of the Protocol provides that “if the Court finds that there has been
violation of a human or peoples’ rights, it shall make appropriate orders to remedy
the violation, including the payment of fair compensation or reparation.”
142. The Court notes that since no violation has been established, the issue of reparation
does
not
arise.
Consequently,
the
Applicant's
prayers
for
reparation
are
dismissed.°°
IX.
COSTS
143. The Applicant did not pray for costs with respect to the Application before this Court.
144. The Respondent State prays that each Party bears its own expenses and costs.
145. The Court notes that Rule 30 of the Rules provides that “unless otherwise decided
by the Court, each Party shall bear its own costs’.
146. The
Court
finds that there
is nothing
in the instant case,
to allow it to decide
otherwise. Accordingly, each Party shall bear tts own costs.
