Rule 100 1. Witnesses and experts victimise or persecute the witnesses or The Commission shall determine, at its own initiative, or at the request of one of the parties, when to call independent experts and witnesses of the parties to the Communication whom it considers necessary to hear in a given case. A request to call a witness by one of the parties shall not be rejected unless the Commission has good _ reasons to believe that such a request constitutes an abuse of process. The invitation to the hearing shall indicate: a. The parties to the A summary of the facts or issues in relation to which the Commission desires to hear the witness or expert. Any such person may, if they do not have sufficient knowledge of the working languages of the Commission, be authorised by the Chairperson to speak in any other language to be interpreted in one of the Working Languages of the Commission. After establishing the identity of the witnesses or experts the Chairperson of the Commission shall request them to take the following oath: a. For witnesses “I swear/affirm that I will speak the truth, the whole truth and nothing but the truth.” b. For the experts “J swear/affirm that my statement will be in accordance with my knowledge, findings and sincere belief” or carry out reprisals 101 Inability of a member of the Commission to take part in the examination of a Communication Rule 1. A member of the Commission shall not be present and take part in the consideration of a Communication if he or she: a. is a national of the State Party concerned; Communication; b. experts, againstthem or their family members because of their statements or expert opinions given before the Commission. b. has any personal interest in the case; c. is engaged in administrative professional incompatible independence d. has participated in any capacity in any decision at the national level in relation to the any political or activity or any activity that is with his or her or impartiality; Communication; e. or has expressed publicly opinions that might be interpreted as reflectinglackofimpartialitywith respect to the Communication. Any question that may arise under paragraph 1 above shall be decided by the Commission without the participation of the member concerned.
