a. That the 2nd - 11th Plaintiffs, not being residents
of Bundu, do not have sufficient interest in the dispute
emanating
from the planned demolition for urban
renewal in that community and, as such, they lack the
standing to institute and maintain the suit. For the 1st
plaintiff, the lack of standing is also based on the fact
that it has not been affected in any way by the acts
attributed to the defendants and there is no public
interest to legitimize the complaint.
b. That the 3rd - 5th defendants are not proper parties
to the
dispute
because,
not
being
ECOWAS
Men1ber States, they are not under the jurisdiction
of the ECOWAS Court of Justice. Therefore, it is
only a High Court in Nigeria that is competent to
hear
the case
and,
as
such,
this
Court
lacks
jurisdiction to entertain same.
c. That the Plaintiffs have not disclosed any cause of
action against the 1st and 2nd defendants.
