The fear of further prosecution and injustice being afflicted on the 4th Plaintiff, forced
him to go into exile, and he now resides in Dakar, Senegal.
The Application was later amended to include the 5th Applicant as a party.
The Applicants aggrieved by the alleged acts of the Defendants have filed this suit
for the enforcement of their fundamental rights as guaranteed under the African
Charter on Human and Peoples Rights, and International Convention on Civil and
Political Rights.
The Defendant upon receipt of the claims so filed against it, filed a preliminary
objection dated 4th January 2016 raising the following issues:a.
There is no paragraph in the narration filed in support of the substantive
application which shows that the 1st Plaintiff is a juristic person duly registered
and only consists of member countries of ECOWAS.
b.
The 1st Plaintiff lacks the locus standi to institute this action.
c.
The 2nd and 4th Plaintiffs’ claim is premature and cannot be maintained
for it does not disclose any cause of action.
d.
The 3rd Plaintiffs' claim is statute barred
e.
The Plaintiffs/Respondents suit before this court is an affront to the
internal sovereignty of the Defendant/Applicant.
The Defendant supported the above objections with legal arguments and decided
authorities.
