Holds that the Respondent State has not violated the Applicant's right to equality before the law and the right to equal protection of the law under Article 3(1) and vi. (2) of the Charter; Holds that the Respondent State has not violated the Applicant's right not to be subjected to cruel, inhuman and degrading treatment under Article 5 of the Charter; 50
