Complainants were requested to present evidence and arguments on admissibility
within two months. The Respondent State was informed of the seizure through a Note
Verbale dated 17 June 2016, which also conveyed the decision on provisional
measures.
18. On 24 November 2016, the Secretariat received a letter from the Complainants which
stated that the evidence and arguments of the complaint are attached to the letter. The
following documents were attached:
Report of the UN Working Group on Arbitrary Detention which mentioned the
enforced disappearance of the Victim, 22 November 2013;
Letters to the Attorney General and Interior Minister concerning the forced
disappearance of the Victim, dated 10 February 2014;
Letters to the Attorney and Ministers of Justice and the Interior on the torture of
the Victim in prison dated 30 March 2016;
Letter to the Minister of the Interior on the denial of prison visits to the family of
the Victim dated 31 March 2016; and
The CV of the Victim.
19. On 06 December 2016, the Secretariat wrote to the Complainants indicating that "the
submissions sent to the Commission do not address the admissibility of the
Communication." ,The Complainants were requested to submit evidence and
arguments on admissibility in accordance with the provisions of Article 56 of the
African Charter.
20. On 19 December 2016, the Complainants submitted a letter to the Secretariat, which
stated that" the evidence and arguments on the admissibility were in the complaint,"
and elaborated on them.
21. Following deliberations at the 61st Ordinary Session, informational letters were once
again transmitted to the Parties. The letter to the Complainants indicated the
following: "[ ... ] the information included in the Complaint does not address all
aspects of the Admissibility of the Communication. You are required to present
evidence and arguments on the admissibility of this Communication in accordance
with Rule 105(1) of the Rules of Procedure of the Commission,". On the other hand,
the Note Verbale to the Respondent State indicated that clarification had been sought
from the Complainants with regards to the information on the admissibility of the
Communication.
22. On 12 March 2018, given that the Complainants had not responded to the Secretariat's
last correspondence, the letters and attached documents earlier submitted by the
Complainants were transmitted to the Respondent State, requesting the latter's
submissions on Admissibility within two months of the request, in accordance wi!9:;:.::::.::
