000808 (ii) Allegation that the Applicant's conviction and sentence was determined on the strength of evidence which was not thoroughly evaluated; (iii) Allegation that the Applicant's right to a fair hearing was violated as a result of the magistrate failing to 'summon his defence witnesses.' 19.The Applicant's reply to these objections is that the Court's jurisdiction is invoked "in so far as the applicant's complaints hinge on the adherence to the principles of human and peoples' rights and freedoms contained in the declaration." 20.The Court recalls its established jurisprudence on the issue and reaffirms that its material jurisdiction is established if the Application brought before it raises allegations of violation of human rights; and it suffices that the subject of the Application relates to the rights guaranteed by the Charter or any other relevant human rights instrument ratified by the State concerned.r 21.The Court notes that this Application invokes violation of the human rights protected by the Charter and other human rights instruments ratified by the Respondent State. 22.Consequently, the Court dismisses the Respondent State's first objection herein. lSee: Application No. 005/2013.
