Nine Hundred and Ninety Rwandan francs (RWF having destabilised his activities and banned 255,456,990) for the movement of his four (4) vehicles; vi. order the Respondent State to pay him compensation in the amount of Fifty-one Hundred Five Billion Two and Twenty Rwandan Hundred Nine Thousand francs (RWF and Twenty Seven 51,226,529,725) Six Hundred Million Five and Twenty for the returns on reinvestment; vii. order the Respondent State to compensate him at the rate of 7.4% for the loss of expected profits; vili.order the Respondent State to pay him an amount of Forty Million Rwandan francs (RWF 40,000,000) for the moral prejudice suffered: ix. order the Respondent State to pay Eight Million Rwandan francs (RWF 8,000,000) for legal costs. x. order the Respondent State to pay the cost of counsel’s fees for the proceedings before the domestic courts and this Court. 26.The Respondent State did not participate in the proceedings before this Court. Therefore, it did not make any prayers in the instant case. V. NON APPEARANCE OF THE RESPONDENT STATE 27. Rule 55 of the Rules of Court provides that: 1. Whenever a party does not appear before the Court or fails to defend its case, the Court may, on the application of the other party, pass judgment in default after it has satisfied itself that the defaulting party has been duly served with the application and all other documents pertinent to the proceedings. 2. Before acceding to the application of the party before it, the Court shall satisfy itself that it has jurisdiction in the case, and that the application is admissible and well founded in fact and in law. 8
