Adjudges that the Applicants' request to the Court, asking it to find that
there is violation of the right to life, security of the human person, and
acts of torture resulting from acts of violence, which are rights enshrined
in Articles 4 and 5 of the African Charter on Human and Peoples' Rights,
is premature as things stand, and inadmissible;
Adjudges that the Republic of Togo violated the Applicants' right to trial
in reasonable time, as enshrined in Article 7(1)-d of the Charter;
Consequently, the Court orders the Republic of Togo to ask its domestic
courts to try the cases brought by Applicants promptly and in such
manner as to render effective the Applicants' right enshrined in Article
7(1)-d of the Charter;
Dismisses the other pleas in law.
COSTS
71. Pursuant to Article 66(2) of the Rules of Procedure of the Court, the Court
asks the Republic of Togo to bear the; costs.
Thus made, declared and pronounced in French, the language of procedure, in
a public session at Abuja, by the Court of Justice of the Economic Community
-, ·· ·of West African States _(ECOWAS) on the day, month and year stated above.
