its decision on the communication.
iii. The Rapporteur for a communication may make such contact as is necessary
with the relevant persons and institutions in the State Party concerned and take
such action as may be appropriate to ascertain the measures adopted by the
State Party concerned in implementing the recommendations of the Committee
made in its decision on the communication.
iv. At each ordinary session of the Committee, the Rapporteur for a Communication
shall present a report during the public session on the progress of the State Party
concerned in implementing the Committee’s decision and make any necessary
recommendations for improving the State’s implementation of the decision.
v. Notwithstanding the provisions of Section XX(3) of these Rules of Procedure,
the Committee shall draw the attention of the Permanent Representatives Committee,
and the Executive Council, to any incidents of non-compliance with the Committee’s
decision on a communication by the State Party concerned.
XXII: LEGAL AID
1) The Committee may, either at the request of the complainant or at its own initiative,
facilitate access to free legal assistance to the complainant in the interest of justice
and within the resources available.
2. Free legal aid shall only be facilitated where the Committee is convinced that:
a) It is essential for the proper discharge of the Committee’s duties, and to
ensure equality of the parties before it; and
b) The complainant has no sufficient means to meet all or part of the costs
involved.
3. In case of urgency or when the Committee is not in session, the Chairperson
may exercise the powers conferred on the Committee under this Section. As soon
as the Committee is in session, any action that has been taken under this paragraph
shall be brought to its attention for confirmation.
