SORS is unlawful, arbitrary and an egregious violation of the Applicant's Fundamental Human Rights as guaranteed by sections 34, 35 and 41 of the Constitution of the Federal Republic of Nigeria 1999 ( As amended), Articles 5,6, and 12 of the African Charter on Human and People’s Rights ( Ratification and Enforcement) Act Cap D9 Laws of the Federation of Nigeria 2004; Articles 9 and 12 of the International Covenant on Civil and Political Rights and Articles 3, 5, 9 and 13 of the Universal Declaration of Human Rights and a most egregious violation of the treaty obligations of the defendant under and by virtue of its being a signatory to the above legal instruments. 1.
