The African Committee of Experts on the Rights and Welfare of the Child (ACERWC) is the first and only child rights treaty body in the world with competence to receive complaints against States. Established by Article 32 of the African Charter on the Rights and Welfare of the Child (ACRWC), its members were first elected in July 2001 after the coming into force of the ACRWC on 29th November 1999. Though having sparsely exercised its complaints handling mandate in its first decade, its uniqueness in the world, and its first decision, demonstrate that it is set to create a most instructive jurisprudence on matters related to the rights of the child. Like the African Commission on Human and Peoples’ Rights (ACmHPR), its jurisdiction is compulsory and automatic for those states that ratify its founding treaty, the ACRWC (Egypt placed a reservation on Arts. 44 and 45 which establish the complaints procedure and investigations mandate). It is composed of eleven (11) members, persons “of high moral standing, integrity, impartiality and competence in matters of the rights and welfare of the child” (ACRWC Art. 33). They serve in their personal capacity. The ACERWC is based in Addis Ababa, Ethiopia, at the African Union (AU) Headquarters.
