X. OPERATIVE PART 119. For these reasons: THE COURT, Unanimously: On jurisdiction i. Dismisses the objections to its material jurisdiction; ii. Declares that it has jurisdiction. On admissibility iii. Dismisses the objections to the admissibility of the Application; iv. Declares that the Application is admissible. On the merits v. Holds that the Respondent State did not violate the Applicants’ right to non-discrimination and equal protection of the law under Articles 2 and 3 of the Charter; vi. Holds that the Respondent State did not violate the Applicants’ right to fair trial under Article 7(1)(a) of the Charter; vii. Holds that the Respondent State did not violate the Applicants’ right to a fair trial, provided under Article 7(1)(c) of the Charter, as read together with Article 14(3)(d) of the ICCPR, due to the failure to accord the Applicants free legal assistance.
