X. OPERATIVE PART 73. For these reasons, THE COURT, Unanimously, On jurisdiction i. Dismisses the objection to its material jurisdiction; ii. Declares that it has jurisdiction; On admissibility iii. Dismisses the objection to the admissibility of the application; iv. Declares the application admissible; On merits v. Finds that the Respondent State has not violated the right to defence protected under Article 7(1) of the Charter in relation to the legality of the charge sheet; vi. Finds that the Respondent State has not violated the right to a fair trial protected under Article 7(1) of the Charter in relation to the evidence relied upon to convict the Applicant. On reparations vii. Dismisses the prayer for reparations. On costs viii. Orders that each Party shall bear its own costs. 17
