FOR THESE REASONS
The Court,
- Adjudicating in a public session, after hearing both Parties, in a matter on
human rights violation, in first and last resort;
- Declares that it has no jurisdiction to adjudicate on all the issues raised by
the Applicant, concerning the decisions of the domestic courts of the
Republic of Niger;
- Declares that it has jurisdiction to adjudicate on the other matters
pleaded in the Application;
- Finds that the dispute is between the same Parties, maintaining the same
former status respectively as Applicant and Defendant, with both Parties
pleading the same cause, and for the same purpose;
- Adjudges that the force of res judicata is upheld and sustained;
- Adjudges therefore that the Application of Hama Amadou is inadmissible;
- Entertains the counter-claim and application for damages brought by the
Defendant;
- Adjudges, however, that the counter-claim and application for damages
brought by the Defendant are ill-founded;
- Dismisses the counter-claim and application for damages brought by the
Defendant;
- Adjudges that each Party shall bear its own costs.
