Case Head Notes: The Commission ruled the Communication was inadmissible because it did not satisfy the requirement of 56(2). The Commission stated that, in the prayers, the Complainants appealed to the Commission to issue Provisional Measures requesting the government of Cameroon to remove its heavy military presence and close down its military outposts in the territory of the former "UN Trust Territory of the Southern Cameroons." The Commission stated that the problem with that request is that it would lead to the interpretation that the Republic of Cameroon and the UN Trust Territory of the Southern Cameroons are two different sovereign states, in which case, one is subject to military occupation. In this regard, the Complaints' request challenged the independence of the Republic of Cameroon. Accordingly, the Commission found that the prayer contravened article 3(b) of the Constitutive Act of the African Union as it would compromise the sovereignty, territorial integrity and independence of a member state. Consequently, the Commission said that the Communication was incompatible with Article 56(2) of the Charter.
