Orders the Respondent State to execute Judgment No. 407
of the Court of Appeal of Abidjan of 13 July 2007, rendered
in the matter of AGEF v. BAEDAN Dogbo Paul et al.;
xvi. Awards the Applicants the amount of Two Hundred and
Thirty-five Million, Three Hundred and Sixty-Six Thousand,
Eight Hundred and Five (235,366,805) CFA Francs as
interest on the principal debt for late payment.
xvii. Awards the Applicants the sum of Nine Hundred and SixtyThree Thousand (963,000) CFA Francs as reimbursement
of costs in respect of bailiff's services;
xviii. Awards the Applicants the sum of Five Million (5,000,000)
CFA Francs as reparation for loss of investment
opportunity.
Moral prejudice
xix. Orders the Respondent State to pay each of the Applicants
the sum of Three Million (3,000,000) CFA Francs as
reparation for moral damage suffered.
On costs
xx.
Dismisses the prayer for reimbursement of procedural
costs;
xxi. Holds that each Party shall bear its own costs.
On implementation and reporting
xxii. Orders the Respondent State to pay all the net amounts
stated in paragraphs xv, xvi, xvii and xix of this Operative
Part, exclusive of tax, within six (6) months from the date of
notification of this judgment, failing which it will also be
required to pay default interest calculated on the basis of
the applicable rate of the Central Bank of West African
