as guaranteed by Sections 34, 35 and 41 of the Constitution of the Federal Republic of Nigeria 1999 ( As amended), Articles 5, 6, and 12 of the African Charter on Human and Peoples’ Rights ( Ratification and Enforcement) Act Cap D9 Laws of the Federation of Nigeria 2004; Articles 9 and 12 of the International Covenant on Civil and Political Rights and Articles 3, 5, 9 and 13 of the Universal Declaration of Human Rights and a most egregious violation of the treaty obligations of the Defendant under and by virtue of its being a signatory to the above legal instruments. ii. A DECLARATION that the detention and continued detention of the Applicant by the officers, servants, agents, prives of the Defendant, after the Applicant met and fulfilled all the bail conditions for his release and after service on the appropriate authorities of the Defendant of release warrants issued by both Federal High Court of Nigeria and the High Court of the Federal Capital Territory, Abuja, Nigeria, is unlawful, arbitrary and constitutes an egregious violation of the Applicant’s human rights as guaranteed by Sections 34, 35 and 41 of the Constitution of the Federal Republic of Nigeria 1999 (As amended)), Articles 5, 6 and 12 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act Cap 10 Laws 8
