IV.
PRAYERS OF THE PARTIES
14. The Applicant prays the Court to direct the Respondent State to:
i.
Vacate the death sentence and grant the Applicant a new trial that
comports with the fair trial guarantees of the African Charter; in the
alternative,
ii.
Set aside the death sentence and grant the Applicant a
resentencing hearing; and
iii. Amend its law to ensure the respect for life.
15. The Respondent State prays the Court to:
i.
Declare that it lacks jurisdiction to hear the Application;
ii.
Declare that the Application is not admissible for not exhausting
local remedies and not being filed within a reasonable time;
iii. Find that the Respondent State has not violated any of the
provisions as alleged by the Applicant; and
iv. Dismiss the prayers of the Applicant and order the latter to bear
the costs of the proceedings.
V.
JURISDICTION
16. The Court observes that Article 3 of the Protocol provides as follows:
1.
The jurisdiction of the Court shall extend to all cases and disputes
submitted to it concerning the interpretation and application of the
Charter, this Protocol and any other relevant Human Rights instrument
ratified by the States concerned.
2.
In the event of a dispute as to whether the Court has jurisdiction, the
Court shall decide.
