B. Alleged violations

The Applicant alleges inter alia the violation of the right of every African adult
person to participate freely in their governance, under Article 13 of the
African Charter on Human and Peoples’ Rights (hereinafter referred to as
“the Charter”) and the right of peoples to participate in public affairs, to vote
and be elected in genuine periodic election under Article 25 of the
International Covenant on Civil and Political Rights (hereinafter referred to
as “the ICCPR”).

SUMMARY OF THE PROCEDURE BEFORE THE COURT

The Application was filed on 1 October 2024. On 17 October 2024, the
Registry informed the Applicant that, as per its jurisprudence, the Court
manifestly lacked jurisdiction to consider an Application against the AU and
the AUC as they are not State Parties to the Protocol to the African Charter
on Human and Peoples’ Rights on the establishment of an African Court on
Human and Peoples’ Rights (hereinafter referred to as “the Protocol”).

Following further exchanges of correspondence between the Registry and
the Applicant, the Application was registered and served on the
Respondents on 29 January 2025. However, the Respondents did not file
any Response thereto.

The Pleadings were closed with effect from 10 February 2025 and the
Parties were notified.
IV.
JURISDICTION
9.
The Applicant avers that this Court has the jurisdiction to determine the
Application as per Article 5(3) and 34(6) of the Protocol.
