Article 30(1) of the Treaty provides as follows: “Subject to the provisions of Article 27 of this Treaty, any person who is resident in a Partner State may refer for determination by the Court, the legality of any Act, regulation, directive, decision or action of a Partner State or an institution of the Community on the grounds that such Act, regulation, directive, decision or action is unlawful or is an infringement of the provisions of this Treaty.” 19. In terms of locus standi therefore, and from the facts pleaded, the Applicant is a fit and proper person to file the Reference. The second limb of this question is whether the act complained of, is one that clothes the EACJ’s First Instance Division with Jurisdiction to determine the Applicant’s allegations against the Respondents. In that regard Article 27 of the Treaty provides as follows: “1. The Court shall initially have jurisdiction over the interpretation and application of this Treaty: Provided that the Court’s jurisdiction to interpret under this paragraph shall not include the application of any such interpretation to jurisdiction conferred REFERENCE NO.8 OF 2010 Page 13
