The Respondent State violated his right to a fair trial under Article
7 of the Charter by depriving him of his right to defence, the right
to be presumed innocent until proven guilty by a competent court
or tribunal and the right to be tried within a reasonable time;
ii.
The Respondent State violated his right to life under Article 4 of
the Charter by imposing a mandatory death sentence upon a
finding of guilt; and
iii. The Respondent State violated his right to dignity under Article 5
of the Charter by sentencing him to death by hanging.
III.
SUMMARY OF THE PROCEDURE BEFORE THE COURT
7.
The Applicant filed his Application on 1 September 2016 and the same was
served on the Respondent State on 15 November 2016.
8.
The Respondent State filed its Response to the Application on 23 April
2018.
9.
The Parties filed all their other pleadings within the time prescribed by the
Court.
10. On 9 February 2022, pleadings were closed and the Parties were duly
notified.
IV.
PRAYERS OF THE PARTIES
11. The Applicant prays the Court to grant him the following orders and
declarations:
i.
That the Respondent State violated his rights under Articles 4, 5, and 7
of the Charter;
ii.
That the Respondent State take appropriate measures to remedy the
violations of his rights under the Charter;
