been located in their records and would be transmitted to the Respondent State.
25. On February 9, 2024, a Note Verbale was sent to the Respondent State, which
specified a 60-day timeline for the Respondent State to submit its observations.
26. The consideration of the Admissibility of the Communication was deferred
from the 61st to the 79th Ordinary Sessions of the Commission.
27. The Commission adopted a decision on Admissibility during its 80th Ordinary
Session, which took place virtually from 24 July to 2 August 2024.

Absence of any insulting or derogaton; terms
28. The Complainant asserts that the language used in this Communication is
devoid of any abusive or derogatory terms towards the Respondent State. It is
employed in good faith to accurately depict the manner, pattern, depth, and
style of the violations.
Prior exhaustion of domestic remedies
29. The Complainant submits that the public ruling issued by the Judges and
Magistrates Vetting Board of Kenya on April 25, 2012, clearly demonstrates the
lack of effective access to local remedies. Consequently, he contends that
fulfilling his responsibilities as a practicing attorney to his clients and
effectively accessing local remedies becomes practically impossible. Referring
to the statement provided by the Judges and Magistrates Vetting Board of
