ri0006g the same time, and should therefore have exercised the requisite judicial remedies so as to exhaust the local remedies. 36. ln light of the foregoing, the Court holds in conclusion that the applicant has not exhausted the local remedies available to him in the Respondent State, and his failure to do so does not fall within the exceptions set out in Rule 40(5) of the Rules. vil. cosTs 37. The Court notes that Rule 30 of the Rules provides that: "Unless otherwise decided by the Court, each party shall bear its own costs." 38. ln view of the circumstances of this case, the Court decides that each party shall bear its own costs.
