2 MAKARATZIS v. GREECE JUDGMENT 4. The application was allocated to the Second Section of the Court (Rule 52 § 1 of the Rules of Court). Within that Section, the Chamber that would consider the case (Article 27 § 1 of the Convention) was constituted as provided in Rule 26 § 1. On 18 October 2001 the application was declared partly admissible by a Chamber of that Section, composed of Mr A.B. Baka, President, Mr C.L. Rozakis, Mrs V. Stráznická, Mr P. Lorenzen, Mr E. Levits, Mr A. Kovler, and Mr V. Zagrebelsky, judges, and Mr S. Nielsen, then Deputy Section Registrar. 5. On 1 November 2001 the Court changed the composition of its Sections (Rule 25 § 1). This case was assigned to the newly composed First Section (Rule 52 § 1). 6. On 5 February 2004, following a hearing on the merits (Rule 59 § 3), a Chamber of that Section, composed of Mrs F. Tulkens, President, Mr C.L. Rozakis, Mr G. Bonello, Mr P. Lorenzen, Mrs N. Vajić, Mr E. Levits, and Mr A. Kovler, judges, and Mr S. Nielsen, Section Registrar, relinquished jurisdiction in favour of the Grand Chamber, none of the parties having objected to relinquishment (Article 30 of the Convention and Rule 72). 7. The composition of the Grand Chamber was determined according to the provisions of Article 27 §§ 2 and 3 of the Convention and Rule 24. 8. On 9 June 2004 third-party comments were received from the Institut de formation en droits de l’homme du barreau de Paris, which had been given leave by the President to intervene in the written procedure (Article 36 § 2 of the Convention and Rule 44 § 2). 9. A hearing took place in public in the Human Rights Building, Strasbourg, on 30 June 2004 (Rule 59 § 3). There appeared before the Court: (a) for the Government Mr M. APESSOS, Senior Adviser, State Legal Council, Mr V. KYRIAZOPOULOS, Adviser, State Legal Council, Mr I. BAKOPOULOS, Legal Assistant, State Legal Council, Delegate of the Agent, Counsel, Adviser; (b) for the applicant Mr Y. KTISTAKIS, Mrs I. KOURTOVIK, Counsel, Mr E. KTISTAKIS, Adviser. The Court heard addresses by Mr Ktistakis, Mrs Kourtovik and Mr Kyriazopoulos.
