In its examination of applications for release, the Brussels Court of Appeal (Indictments Division) has developed case-law that takes into account the risks faced by the persons concerned were they to be sent back to Greece, as well as the Court’s finding that Greece was violating its obligations under Article 3 (see S.D. v.
