3. The 2-4 defendant, Mr. Haruna Warkani is the ECOWAS Secretariat, Staff Representative, 4. The 3" defendant Mr. Jules Gogoua is also the ECOWAS Staff Representative. B. SUMMARY OF THE FACTS OF THE CASE 5. By Application dated 21/03/05, lodged at the Registry of the Community Court of Justice on the same day, MRS Adebayo Esq. registered Lijadu-Oyemade Tokunbo, whose counsel is Wole with the Abuja Bar (Nigeria), filed a suit seeking the following orders: 1). Declaring illegal and contrary to Article 65 of the ECOWAS Staff Regulations, the sanction of summary dismissal imposed on her by the Executive Secretary and which failed or refused to suspend the decision after receiving a notification invoking her right of appeal; 2.) Declaring illegal and contrary to Article 65 of the ECOWAS Staff Regulations, the act of Messrs. Haruna Warkani and Jules Gogoua as demonstrated by their failure or refusal to recognise her right to appeal or to present a memorandum to the Administration and Finance Commission; 3) Declaring illegal and contrary to Article 65 of the Staff Regulations, the publication by the Executive Secretary of the vacancy notice for the post of Director of Administration whereas the appeal to cancel the sanction of summary dismissal remains in the process; 4) Declaring illegal and contrary to the Staff Regulations, the infringement upon her right to salary and other emoluments attached to the postof Director of Administration in ordering, such salary and emoluments whereas her appeal is in the process; to be frozen from September 2004 till today,
