CHAPTER II TRANSITIONAL PROVISIONS Article 5 Term of Office of the Judges of the African Court on Human and Peoples’ Rights In Article 4 (Term of Office of the Judges of the African Court on Human and Peoples’ Rights), replace the existing provision including its title, with: “Article 4 Term of Office of the Judges of the African Court on Human and Peoples’ Rights 4. Upon the coming into force of the Protocol on the Statute of the African Court of Justice and Human Rights, the terms and appointment of the Judges of the African Court on Human and Peoples’ Rights shall terminate. 2 Without prejudice to paragraph 1, the Judges of the African Court on Human and Peoples’ Rights shall remain in office until the judges of the African Court of Justice and Human and Peoples’ Rights are sworn in. Article 6 Pending Cases At the entry into force of this Protocol, where any matter affecting any State had already been commenced before either the African Court on Human and Peoples’ Rights or the African Court of Justice and Human Rights, if in force, such a matter shall be continued before the relevant Section of the African Court of Justice and Human made by the Court. and Peoples’ Rights, pursuant to such Rules as may be Article 6bis Temporary Jurisdiction At the entry into force of this Protocol, until a Member State ratifies it, any jurisdiction which has hitherto been accepted by such Member State with respect to either the African Court on Human and Peoples’ Rights or the African Court of Justice and Human Rights shall be exercisable by this Court.
