98. For these reasons,
THE COURT,
Unanimously,
On jurisdiction
i.
Dismisses the Respondent State’s objection to its jurisdiction;
ii.
Declares that it has jurisdiction.
On admissibility
iii. Dismisses the objections to the admissibility of the Application.
iv. Declares the Application admissible.
On merits
v. Finds that the Respondent State did not violate the Applicant’s right
to equality before the law and equal protection of the law under
Article 3(1) and (2) of the Charter;
vi. Finds that the Respondent State violated the Applicant’s right
guaranteed by Article 7(1)(c) of the Charter read together with
Article 14(3)(d) of the ICCPR, by failing to afford him free legal
assistance.
Pecuniary reparations
vii. Awards the Applicant the sum of Three Hundred Thousand
(300,000) Tanzanian shillings as reparation for moral prejudice
suffered as a result of the violation of his right to free legal
assistance.
viii. Orders the Respondent State to pay the amount awarded under (vii)
above, free from tax, as fair compensation within six (6) months
