Amended Miscellaneous Application Number 3 of 2008, seeking leave to lodge a fresh appeal out of time. On 11 June 2008, the High Court, being satisfied that the Applicant had complied with the Order to file the amended Application, granted the Applicant leave to file the Notice of Appeal to the Court of Appeal within ten (10) days thereof. On 13 June 2008, the Applicant filed at the High Court of Tanzania at Moshi, a Notice of Appeal to the Court of Appeal. This new appeal to the Court of Appeal was filed as Criminal Appeal Number 230 of 2008. 32. On 10 July 2008, the Applicant wrote a letter to the Registrar of the Court of Appeal to inform him of the delay in the hearing of his appeal. On 2 February 2009 the Applicant wrote a letter to the District Registrar of the High Court of Tanzania at Moshi requesting the record of the proceedings at the High Court. On 17 March 2009, the Applicant received a copy of the court record. 33. On 29 May 2009, the Court of Appeal delivered its judgment in Criminal Appeal Number 230 of 2008, dismissing the appeal, and finding that the prosecution's case had merit, upheld the Applicant\> conviction and sentence. 34. On 10 June 2009, the Applicant filed a Notice of Motion for review of the decision of the Court of Appeal in Criminal Appeal Number 230 of 2008. On 4 January 2010, the Applicant wrote to the Chief Justice of the United Republic of Tanzania reminding him of his request for pro bono legal counsel and requesting hearing of his Application for Review. 16
