ARTICLE 3.2 INTEGRATED TRANSPORT POLICY 1. In order to attain the desired integrated transport objectives, Member States agree to develop a harmonised integrated transport policy, which includes the a) establishment of infrastructure, logistical systems and institutional frameworks; b) establishment of appropriate legal and financial frameworks; c) execution of research and technology transfer; and d) development of effective communication networks; which support intra- and intermodal synergy and optimal utilization of modes. 2. Member States shall apply the following principles a) the right of freedom of transit for persons and goods; b) the right of land-locked Member States to unimpeded access to and from the sea; c) the right of coastal Member States to unimpeded access to and from land-locked Member States; d) equality of treatment of the nationals and passenger service providers of Member States with regard to the provision, access and use of infrastructure and immigration and clearance procedures; e) the right of individual Member States to negotiate access and freedom of transit rights consistent with the principles of this Protocol, while recognising that individual needs of Member States may require specific bilateral arrangements; and f) all modes of transport are allowed the necessary economic space to operate in a selfsustaining free market environment. 3. Member States shall, in the exercise of their full sovereignty over their territory, have the right to take all measures necessary to ensure that the application of the principles contemplated in paragraph 2 shall in no way infringe their legitimate interests. ARTICLE 3.3 INFRASTRUCTURE 1. Member States shall co-operate in providing, operating and maintaining transport infrastructure which supports the provision of integrated transport services, considering that infrastructure should progressively be self-sustaining with funding based on a user pay principle. 2. To this end, Member States shall create and maintain regulatory frameworks, investment regimes and incentives which may facilitate the provision of such infrastructure by the private and/or public sector.
