The Principles and Guidelines: These Principles and Guidelines supplement existing standards, in particular the Guidelines and Measures for the Prohibition and Prevention of Torture, Cruel, Inhuman or Degrading Treatment or Punishment in Africa, the Guidelines on the Conditions of Arrest, Police Custody and Pre-Trial Detention in Africa, the Principles and Guidelines on the Right to a Fair Trial and Legal Assistance in Africa, and the Global Principles on National Security and the Right to Information (“Global Principles” or “Tshwane Principles”). Nothing in the Principles and Guidelines shall be construed as restricting or derogating from rights protected under regional and international human rights, humanitarian, and refugee law. If conflicts between provisions of the Principles and Guidelines and other international and regional human rights standards arise, the more protective provision takes precedent.
