obliged to prosecute or extradite alleged perpetrators of torture when they are present in any territory under their jurisdiction and to adopt the necessary legislation to make this possible." 117 The Commission finds that by omitting to prosecute, the Respondent State neglected its Due diligence obligation. 181. In view of the foregoing, and based on the analysis above, the Commission considers that the Respondent State not only failed to conduct an effective investigation, prosecute and punish the victim's perpetrator, but also through its agents participated in conduct that added to her unfortunate ordeals. As a consequence, the Commission finds that the ~espondent State is in violation of Article 5 of the Charter and Article 4(2)(g) of the Maputo Protocol. Alleged violation of Articles 2 and 18(3) of the Charter and 2 of the Maputo Protocol 182. The Complainants submit that by failing to investigate, prosecute and punish the Victim's trafficking for sexual exploitation, which amounts to discrimination on the basis of sex, gender and age, the Respondent State is in violation of Articles 2 and 18(3) of the Charter and 2 of the Maputo Protocol. 118 Furthermore, the Complainants ·appeal to the Commission to determine that discrimination occurred not through the comparator test which is premised on formal equality, but rather through a substantive equality test which considers the victim's context and systemic disadvantage as a woman.119 The Commission notes that in the Respondent State's submissions, no substantive oints were made regarding the allegations on the violation of Articles 2/a d"fi[3), @ Charter and 2 of the Maputo Protocol respectively.
